Taken into custody to await trial by Court Martial for disobeying an order

Tried by a Field General Court Martial and charged with

 1.     When on active service, disobeying a command given by his superior officer, in that he at Havre on the 5th of February, 1917 did not report to the corral and fetch in horses at once when ordered to do so by a superior.

He testified that he had applied on multiple occasions to be transferred to a fighting battalion and was refused and this made him unhappy.

He was found Guilty and sentenced to 14 days Field Punishment No. 2
